{"id":52815,"date":"2023-08-02T14:33:12","date_gmt":"2023-08-02T14:33:12","guid":{"rendered":"https:\/\/rdnews.al\/?p=52815"},"modified":"2023-08-02T14:33:12","modified_gmt":"2023-08-02T14:33:12","slug":"be-jep-alarmin-korrupsioni-i-zyrtareve-te-larte-nuk-konsiderohet-krim-i-rende-ne-shqiperi","status":"publish","type":"post","link":"https:\/\/foltore.al\/index.php\/2023\/08\/02\/be-jep-alarmin-korrupsioni-i-zyrtareve-te-larte-nuk-konsiderohet-krim-i-rende-ne-shqiperi\/","title":{"rendered":"BE jep alarmin: Korrupsioni i zyrtar\u00ebve t\u00eb lart\u00eb nuk konsiderohet krim i r\u00ebnd\u00eb n\u00eb Shqip\u00ebri"},"content":{"rendered":"<p>Raporti i sapo publikuar i Komisionit Evropian \u201cShqip\u00ebria Screening 2023\u201d paraqet vler\u00ebsimin e tij p\u00ebr situat\u00ebn n\u00eb Shqip\u00ebri pas p\u00ebrfundimit t\u00eb raundit t\u00eb par\u00eb t\u00eb bisedimeve Shqip\u00ebri-BE lidhur p\u00ebrparimin drejt standardeve q\u00eb k\u00ebrkon an\u00ebtar\u00ebsimi, q\u00eb nga hapja e negociatave n\u00eb korrik 2022.<\/p>\n<p>Sipas vler\u00ebsimeve t\u00eb Komisionit Evropian (KE) Shqip\u00ebria paraqitet me nj\u00eb p\u00ebrgatitje t\u00eb moderuar dhe me p\u00ebrputhje t\u00eb pjesshme t\u00eb legjislacionit t\u00eb saj me at\u00eb t\u00eb BE n\u00eb disa sektor\u00eb dhe n\u00eb nivel t\u00eb lart\u00eb n\u00eb sektor\u00eb t\u00eb tjer\u00eb ku l\u00eb p\u00ebr t\u00eb d\u00ebshiruar zbatimi i ligjeve.<\/p>\n<p><strong>Korrupsioni i zyrtar\u00ebve t\u00eb lart\u00eb i paklasifikuar si krim i r\u00ebnd\u00eb<\/strong><\/p>\n<p>\u201cKuadri legjislativ dhe institucional i Shqip\u00ebris\u00eb p\u00ebr anti-korrupsionin \u00ebsht\u00eb pjes\u00ebrisht n\u00eb p\u00ebrputhje me legjislacionin e BE. Masat kund\u00ebr korrupsionit vazhdojn\u00eb t\u00eb ken\u00eb, n\u00eb p\u00ebrgjith\u00ebsi nj\u00eb ndikim t\u00eb kufizuar n\u00eb sektor\u00eb te till\u00eb t\u00eb c\u00ebnuesh\u00ebm si infrastruktura publike, kadastra, t\u00eb drejtat pron\u00ebsore, doganat, taksat, administrate publike, arsimi, sh\u00ebndet\u00ebsia, prokurimet publike dhe kontratat Partneritet Publik-Privat.<\/p>\n<p>Ndaj zyrtar\u00ebve t\u00eb lart\u00eb ka patur disa d\u00ebnime p\u00ebrfundimtare p\u00ebr akuzat p\u00ebr korrupsion por deri m\u00eb tani asnj\u00eb d\u00ebnim nuk i \u00ebsht\u00eb referuar klasifikimit t\u00eb akteve t\u00eb korrupsionit si krim i r\u00ebnd\u00eb, \u201d theksohet n\u00eb raportin e KE.<\/p>\n<p>Sipas raportit \u201cShqip\u00ebria \u00ebsht\u00eb pjes\u00ebrisht n\u00eb linj\u00eb me direktiv\u00ebn e BE, t\u00eb Parlamentit dhe K\u00ebshillit Evropian p\u00ebr luft\u00ebn kund\u00ebr mashtrimit\u201d.<\/p>\n<p>\u201cEkzistojn\u00eb dispozita p\u00ebr sekuestrimin dhe konfiskimin e fitimeve t\u00eb ardhura nga nj\u00eb vep\u00ebr penale. Shqip\u00ebria do t\u00eb duhet t\u00eb zbatoj\u00eb plot\u00ebsisht direktiv\u00ebn e BE p\u00ebr ngrirjen dhe konfiskimin e instrumenteve dhe produkteve t\u00eb krimit, t\u00eb rris\u00eb koherenc\u00ebn e kuadrit ligjor dhe institucional p\u00ebr parandalimin e korrupsionit dhe integritetin e zyrtar\u00ebve publik\u00eb , sidomos atyre t\u00eb nivelit t\u00eb lart\u00eb,\u201d rekomandon KE n\u00eb raportin e sip\u00ebrp\u00ebrmendur.<\/p>\n<p>KE vler\u00ebson q\u00eb p\u00ebrparimi i Shqip\u00ebris\u00eb p\u00ebr t\u2019i dh\u00ebn\u00eb fund pand\u00ebshkueshm\u00ebris\u00eb s\u00eb korrupsionit n\u00eb nivel t\u00eb lart\u00eb nuk \u00ebsht\u00eb vendimtar.<\/p>\n<p>\u201cDuhet t\u00eb arrihet nj\u00eb histori solide n\u00eb luft\u00ebn sistematike kund\u00ebr korrupsionit, ve\u00e7an\u00ebrisht. t\u00eb atij n\u00eb nivel t\u00eb lart\u00eb, duke p\u00ebrfshir\u00eb konfiskimin p\u00ebrfundimtar t\u00eb aseteve. Sekuestrimi dhe konfiskimi i aseteve kriminale q\u00eb rezultojn\u00eb nga veprat penale t\u00eb lidhura me korrupsionin \u00ebsht\u00eb ende mjaft i kufizuar. Shumat e pasuris\u00eb s\u00eb sekuestruar nuk pasqyrohen n\u00eb shumat e konfiskuara. Progres \u00ebsht\u00eb b\u00ebr\u00eb n\u00eb mas\u00ebn e procedurave t\u00eb konfiskimit por pa d\u00ebnim sipas ligjit Anti-Mafia. Rezultatet p\u00ebr sekuestrimin dhe konfiskimin jasht\u00eb vendit gjithashtu duhet t\u00eb p\u00ebrmir\u00ebsohen,\u201d i rekomandon KE Shqip\u00ebris\u00eb..<\/p>\n<p><strong>SPAK-u duhet t\u00eb forcohet dhe konsolidohet<\/strong><\/p>\n<p>Q\u00eb kjo t\u00eb arrihet KE rekomandon forcim dhe konsolidimin e kapaciteteve operacionale dhe njer\u00ebzore t\u00eb Struktur\u00ebs s\u00eb Posacme Anti-Korrupsion,(SPAK) dhe Gjykat\u00ebs p\u00ebr Korrupsionin dhe Krimin e Organizuar (GJKK).<\/p>\n<p>\u201cSPAK duhet t\u00eb ket\u00eb nj\u00eb qasje proaktive p\u00ebr t\u00eb luftuar korrupsionin n\u00eb nivel t\u00eb lart\u00eb. Shqip\u00ebria duhet t\u00eb siguroj\u00eb q\u00eb SPAK t\u00eb ket\u00eb akses n\u00eb t\u00eb gjitha bazat e t\u00eb dh\u00ebnave p\u00ebrkat\u00ebse dhe bashk\u00ebpunim mes prokuror\u00ebve, hetuesve dhe autoriteteve shtet\u00ebrore p\u00ebr t\u00eb trajtuar n\u00eb m\u00ebnyr\u00eb efektive korrupsionin. SPAK ka nevoj\u00eb p\u00ebr nj\u00eb sistem modern t\u00eb menaxhimit t\u00eb \u00e7\u00ebshtjeve dhe mbledhjen elektronike t\u00eb t\u00eb dh\u00ebnave , q\u00eb aktualisht b\u00ebhet manualisht,\u201d thekson KE.<\/p>\n<p>Sipas vler\u00ebsimit t\u00eb KE , edhe pse jan\u00eb dh\u00ebn\u00eb disa d\u00ebnime p\u00ebrfundimtare p\u00ebr akuzat p\u00ebr korrupsion kund\u00ebr zyrtar\u00ebve t\u00eb lart\u00eb \u201cka mosp\u00ebrputhje midis numrit t\u00eb hetimeve dhe numrit t\u00eb d\u00ebnimeve p\u00ebrfundimtare\u201d.<\/p>\n<p>\u201cRritja e numrit t\u00eb d\u00ebnimeve p\u00ebrfundimtare t\u00eb zyrtar\u00ebve t\u00eb nivelit t\u00eb lart\u00eb duhet t\u00eb mbetet nj\u00eb prioritet i r\u00ebnd\u00ebsish\u00ebm p\u00ebr t\u00eb trajtuar m\u00eb tej kultur\u00ebn e mosnd\u00ebshkimit,\u201d v\u00eb n\u00eb dukje KE..<\/p>\n<p><strong>Kadastra \u2013 pa masa efektive kund\u00ebr korrupsionit<\/strong><\/p>\n<p>E drejta e pron\u00ebs edhe pse e sanksionar n\u00eb Kushtetut\u00eb p\u00ebr nj\u00eb pjes\u00eb t\u00eb konsiderueshme t\u00eb qytetar\u00ebve t\u00eb Shqip\u00ebris\u00eb mbetet ende n\u00eb let\u00ebr, e parealizuar n\u00eb praktik\u00eb. KE n\u00eb raportimin e tij \u201eShqip\u00ebria -Screening 2023\u2033 ndalet tek roli q\u00eb luan korrupsioni n\u00eb Kadastra n\u00eb mohimin e t\u00eb drejt\u00ebs s\u00eb pron\u00ebsis\u00eb.<\/p>\n<p>Situata e r\u00ebnduar lidhur me t\u00eb drejt\u00ebn e pron\u00ebs paraqitet p\u00ebrmes t\u00eb dh\u00ebnash alarmante t\u00eb tilla si 7 mij\u00eb k\u00ebrkesa t\u00eb pashqyrtuara p\u00ebr kthimin e pron\u00ebs tek pronar\u00ebt dhe 4 mij\u00eb vendime t\u00eb pazbatuara t\u00eb Gjykat\u00ebs Europiane p\u00ebr t\u00eb Drejtat e Njeriut n\u00eb Strasburg, ku qytetar\u00ebt e Shqip\u00ebrin\u00eb kan\u00eb \u04abuar \u04ab\u00ebshtjet e tyre t\u00eb pron\u00ebs, kur gjykatat vendase me vendimet e tyre kan\u00eb shkelur t\u00eb drejt\u00ebn e pron\u00ebsis\u00eb. Rreth 500 mij\u00eb prona figurojn\u00eb te paregjistruara dhe 80 p\u00ebr qind e t\u00eb dh\u00ebnave p\u00ebr pronat e regjistruara jan\u00eb t\u00eb pasakta.<\/p>\n<p>\u201d Ka shqet\u00ebsime p\u00ebr raportime lidhur me korrupsionin n\u00eb Agjencin\u00eb Shtet\u00ebrore t\u00eb Kadastr\u00ebs. Kjo agjenci duhet t\u00eb adresoj\u00eb urgjentisht korrupsionin dhe parregullsi t\u00eb tjera q\u00eb lidhen me regjistrimin e pronave dhe t\u00eb vendos\u00eb standarde t\u00eb larta t\u00eb transparenc\u00ebs. Shqip\u00ebria duhet t\u00eb siguroj\u00eb q\u00eb t\u00eb respektohet e drejta p\u00ebr nj\u00eb gjykim t\u00eb drejt\u00eb dhe zgjidhje efektive t\u00eb s\u00eb drejt\u00ebs s\u00eb pron\u00ebsis\u00eb, \u201d thekson KE.<\/p>\n<p><strong>Trafikimit t\u00eb qenieve njer\u00ebzore<\/strong><\/p>\n<p>KE konstaton q\u00eb qytetar\u00ebt e Shqip\u00ebris\u00eb trafikohen n\u00eb vendet fqinje dhe shtetet an\u00ebtare t\u00eb BE p\u00ebr shfryt\u00ebzim seksual, pun\u00eb dhe kriminalitet t\u00eb detyruar.<\/p>\n<p>\u201cF\u00ebmij\u00ebt e vendosur n\u00eb institucione dhe f\u00ebmij\u00ebt nga komuniteti rom dhe egjiptian jan\u00eb ve\u00e7an\u00ebrisht t\u00eb cenuesh\u00ebm ndaj trafikimit\u201d thekson raporti.<\/p>\n<p>Sipas KE identifikimi i viktimave t\u00eb mundshme brenda territorit shqiptar apo nd\u00ebr emigrant\u00ebt q\u00eb hyjn\u00eb n\u00eb vend \u00ebsht\u00eb i pamjaftuesh\u00ebm. Korniza e p\u00ebrmir\u00ebsuar legjislative p\u00ebr viktimat, ende nuk \u00ebsht\u00eb zbatuar.
