Pozicioni i presidentit amerikan k\u00ebrkon q\u00eb t\u2019i vendos\u00eb fre aksesit t\u00eb tepruar nga ana e sh\u00ebrbimeve amerikane t\u00eb siguris\u00eb, q\u00eb kishte p\u00ebrb\u00ebr\u00eb thelbin e mosdakord\u00ebsis\u00eb dhe r\u00ebnduar substancialisht mbi anullimin e <em>Privacy Shield<\/em>.<\/p>\n<p>Prandaj Urdh\u00ebri Ekzekutiv i Joe Biden \u00ebsht\u00eb i prirur t\u2019i rip\u00ebrcaktoj\u00eb n\u00eb prizmin e p\u00ebrgjithsh\u00ebm finalitetet, si edhe kufizimet dhe p\u00ebrgjegj\u00ebsit\u00eb t\u00eb cilave do t\u2019u n\u00ebnshtrohen agjencit\u00eb amerikane t\u00eb inteligjenc\u00ebs, jo vet\u00ebm n\u00eb nivel normativ, por edhe operativ. Kjo implikon q\u00eb mjetet t\u00eb cilat p\u00ebrdor vendi i tret\u00eb mund t\u00eb ndryshojn\u00eb nga ato t\u00eb p\u00ebrdorura nga Bashkimi Europian boll q\u00eb t\u00eb demonstrohen n\u00eb thelb efikas\u00eb p\u00ebr t\u00eb garantuar nj\u00eb nivel mbrojtjeje t\u00eb duhur. N\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb, Bashkimi Europian nuk k\u00ebrkon q\u00eb normat e tij t\u00eb replikohen nj\u00eblloj nga Shtetet e Bashkuara, sesa q\u00eb e drejta e privat\u00ebsis\u00eb n\u00eb devijimet e tij t\u00eb jet\u00eb e garantuar si n\u00eb Bashkimin Europian, aq edhe Shtetet e Bashkuara.<\/p>\n<p><strong>Midis Urdh\u00ebrit Ekzekutiv dhe shqiptimit t\u00eb p\u00ebrshtatshm\u00ebris\u00eb: <em>Foreign Intelligence Surveillance Act<\/em><\/strong><\/p>\n<p>R\u00ebnd\u00ebsia e flukseve t\u00eb t\u00eb dh\u00ebnave midis Bashkimit Europian dhe Shteteve t\u00eb Bashkuara ndahet nga t\u00eb dyja pal\u00ebt, q\u00eb jan\u00eb t\u00eb vet\u00ebdijsh\u00ebm p\u00ebr benefitet e fituara. Pik\u00ebrisht p\u00ebr shkak t\u00eb fluksit t\u00eb t\u00eb dh\u00ebnave, Max Scherms, aktivist dhe avokat, ka treguar ngurrim m\u00eb t\u00eb madh p\u00ebrball\u00eb Urdh\u00ebrit Ekzekutiv t\u00eb miratuar nga Sht\u00ebpia e Bardh\u00eb, duke theksuar edhe nj\u00eb her\u00eb akoma sesi ligji <em>Foreign Intelligence Surveillance Act<\/em> (FISA) 702 \u2013 n\u00eb fuqi n\u00eb Shtetet e Bashkuara, autorizon agjencit\u00eb kryesore t\u00eb inteligjenc\u00ebs si NSA, FBI dhe CIA t\u00eb koleksionojn\u00eb dhe p\u00ebr pasoj\u00eb t\u00eb p\u00ebrdorin informacionet lidhur me qytetar\u00ebt banor\u00eb jasht\u00eb vendit \u2013 p\u00ebrfaq\u00ebson nj\u00eb shkelje t\u00eb r\u00ebnd\u00eb ndaj parimit t\u00eb proporcionalitetit t\u00eb parashikuar nga GDPR. Me v\u00ebmendje t\u00eb ve\u00e7ant\u00eb ndaj aksesit t\u00eb t\u00eb dh\u00ebnave personale nga ana e agjencive amerikane t\u00eb inteligjenc\u00ebs, faktikisht parashikohet q\u00eb k\u00ebta njer\u00ebz mund t\u00eb k\u00ebrkojn\u00eb aksesin n\u00eb t\u00eb dh\u00ebnat personale q\u00eb u jan\u00eb transferuar organizatave t\u00eb ndodhura n\u00eb Shtetet e Bashkuara p\u00ebr motive t\u00eb siguris\u00eb komb\u00ebtare jo vet\u00ebm n\u00eb rastet e parashikuara nga ligji, ashtu si\u00e7 parashikohet n\u00eb kuptimet e FISA. Kjo p\u00ebrb\u00ebn themelet p\u00ebr ta legjitimuar mbledhjen dhe trajtimin pasues t\u00eb t\u00eb dh\u00ebnave personale t\u00eb transferuara duke u nisur nga Kontinenti i Vjet\u00ebr.<\/p>\n<p><strong>Privat\u00ebsia n\u00eb Shtetet e Bashkuara<\/strong><\/p>\n<p>Duhet konsideruar gjithashtu sesi koncepti i privat\u00ebsis\u00eb n\u00eb Shtetet e Bashkuara \u00ebsht\u00eb kusht\u00ebzuar dhe shtyr\u00eb n\u00eb nj\u00eb ndryshim n\u00eb vite. Koncepti i privat\u00ebsis\u00eb n\u00eb Shtetet e Bashkuara n\u00eb 20 vje\u00e7arin e fundit \u00ebsht\u00eb kusht\u00ebzuar fuqimisht nga ngjarjet e 11 shtatorit dhe m\u00eb pas nga aksionet e shumta malinje q\u00eb Uashingtoni dhe, p\u00ebr refleks, Shtetet e Bashkuara kan\u00eb p\u00ebsuar. Megjith\u00ebse ka nj\u00eb konstante t\u00eb pandryshuar, privat\u00ebsia ndeshet me konceptin e siguris\u00eb komb\u00ebtare. Koncepti i privat\u00ebsis\u00eb nuk \u00ebsht\u00eb i sanksionuar direkt nga kushtetuta amerikane, megjithat\u00eb <em>Bill of Rights <\/em>ia ruan disa aspekte n\u00ebp\u00ebrmjet amendamenteve I, III, IV dhe V. Amendamenti i IX, interpretimi i t\u00eb cilit \u00ebsht\u00eb debatuar, e justifikon leximin e thelluar t\u00eb <em>Bill of Rights <\/em>p\u00ebr ta mbrojtur privat\u00ebsin\u00eb n\u00eb m\u00ebnyra jospecifikisht t\u00eb parashikuar nga amendamentet e tjera. Studiuesit e gjejn\u00eb t\u00eb v\u00ebshtir\u00eb t\u00eb rakordohen mbi nj\u00eb koncept t\u00eb vet\u00ebm privat\u00ebsie, duke preferuar t\u00eb n\u00ebnvizojn\u00eb aspekte t\u00eb ndryshme t\u00eb t\u00eb nj\u00ebjtit. Me p\u00ebrkufizim po aq t\u00eb v\u00ebshtir\u00eb rezulton edhe koncepti i siguris\u00eb komb\u00ebtare. Sipas disa ekspert\u00ebve do t\u00eb ishte aft\u00ebsia e institucioneve komb\u00ebtare p\u00ebr t\u2019i parandaluar kund\u00ebrshtar\u00ebt nga drejtimi i p\u00ebrdorimit t\u00eb forc\u00ebs p\u00ebr t\u2019i d\u00ebmtuar qytetar\u00ebt amerikan\u00eb apo interesat komb\u00ebtare t\u00eb tyre dhe besimin e tyre n\u00eb nj\u00eb aft\u00ebsi t\u00eb till\u00eb t\u00eb qeveris\u00eb, duke ofruar nj\u00eb vizion t\u00eb militarzuar t\u00eb siguris\u00eb. Edhe Leon Panetta, drejtor i CIA midis viteve 2009 e 2011 dhe m\u00eb pas sekretar i Mbrojtjes deri m\u00eb 2013, ka theksuar gjer\u00ebsisht r\u00ebnd\u00ebsin\u00eb e faktorit sekret p\u00ebr ta mbrojtur sigurin\u00eb komb\u00ebtare n\u00eb kontekstin e ri nd\u00ebrkomb\u00ebtar. Krucialiteti i konceptit t\u00eb privat\u00ebsis\u00eb e forcon k\u00ebshti karakterin gjeopolitik t\u00eb t\u00eb dh\u00ebnave. Ky \u00ebsht\u00eb \u00e7el\u00ebsi p\u00ebr nj\u00eb pozicionim europian n\u00eb skenarin global t\u00eb bazuar mbi nj\u00eb ekuilib\u00ebr t\u00eb ri pushteti t\u00eb bazuar gjithmon\u00eb tek t\u00eb dh\u00ebnat. Faktikisht, kush i mban si edhe i p\u00ebrpunon t\u00eb dh\u00ebnat g\u00ebzon nj\u00eb avantazh kompetitiv jo t\u00eb par\u00ebnd\u00ebsish\u00ebm. P\u00ebr nj\u00eb qllim t\u00eb till\u00eb, vler\u00ebsimi i p\u00ebrshtatshm\u00ebris\u00eb i Komisionit Europian duhet t\u00eb p\u00ebrmbaj\u00eb domosdoshm\u00ebrisht brenda tij edhe sesi nj\u00eb vendim i till\u00eb do t\u00eb ket\u00eb impakte mbi kompetitivitetin e bizneseve europiane n\u00eb tregun global. Nuk \u00ebsht\u00eb rast\u00ebsi q\u00eb Shtetet e Bashkuara kan\u00eb n\u00ebnkuptuar gjithmon\u00eb dhe vazhdojn\u00eb ta mbrojn\u00eb interesin komb\u00ebtar n\u00ebp\u00ebrmjet mbrojtjes si interesave t\u00eb bizneseve komb\u00ebtare q\u00eb shfaqen n\u00eb skakier\u00ebn nd\u00ebrkomb\u00ebtare. T\u00eb dish t\u2019i jap\u00ebsh vler\u00eb mas\u00ebs s\u00eb madhe t\u00eb t\u00eb dh\u00ebnave q\u00eb p\u00ebrshkruarn \u00e7do aspekt t\u00eb jet\u00ebs \u00ebsht\u00eb prej nj\u00eb kohe t\u00eb gjate nj\u00eb instrument gjeopolitike n\u00eb t\u00eb gjitha aspektet.<\/p>\n<p><strong>Konkluzione<\/strong><\/p>\n<p>N\u00eb p\u00ebrfundim, nga vendimi i p\u00ebrshtatshm\u00ebris\u00eb i p\u00ebrhapur nga Komisioni Europian dhe nga Urdh\u00ebri Ekzekutiv i Sht\u00ebpis\u00eb s\u00eb Bardhe del mbijetesa e e\u00ebement\u00ebve p\u00ebr t\u00eb nd\u00ebrtuar nj\u00eb framework t\u00eb ri normativ p\u00ebr fluksin e t\u00eb dh\u00ebnave midis Bashkimit Europian dhe Shteteve t\u00eb Bashkuara, n\u00eb respektim t\u00eb legjislacioneve dhe t\u00eb tutelave ndaj shteteve, pse jo edhe qytetar\u00ebve, n\u00eb linj\u00eb edhe me sa parashikohet nga GDPR. Kjo af\u00ebrsi me nj\u00eb marr\u00ebveshje t\u00eb re megjithat\u00eb nuk i heq t\u00eb gjitha pengesat nga rrug\u00ebtimi. Faktikisht, mbesin t\u00eb q\u00ebndrueshme t\u00eb gjitha instrumentat ligjor\u00eb n\u00eb dispozicion.
