{"id":16517,"date":"2022-06-30T20:22:21","date_gmt":"2022-06-30T20:22:21","guid":{"rendered":"https:\/\/rdnews.al\/?p=16517"},"modified":"2022-06-30T20:28:16","modified_gmt":"2022-06-30T20:28:16","slug":"narco-republike-me-ligj-te-trafikosh-droge-nuk-denohesh-me-me-burg","status":"publish","type":"post","link":"https:\/\/foltore.al\/index.php\/2022\/06\/30\/narco-republike-me-ligj-te-trafikosh-droge-nuk-denohesh-me-me-burg\/","title":{"rendered":"Narco-Republik\u00eb me ligj, t\u00eb trafikosh drog\u00eb nuk d\u00ebnohesh m\u00eb me burg"},"content":{"rendered":"<p>Pak dit\u00eb pasi Shqip\u00ebria u rendit e shtata n\u00eb bot\u00eb p\u00ebr vendet e p\u00ebrmendura n\u00eb trafikun e kanabisit, qeveria Rama hodhi p\u00ebr konsultim projekt-ligjin q\u00eb i hap rrug\u00eb kultivimit t\u00eb kanabisit mjek\u00ebsor.<br \/>\nIdeja \u00ebsht\u00eb pritur mes kund\u00ebrshtimesh t\u00eb forta, pasi tregu i kanabisit \u00ebsht\u00eb kontrolluar deri tani nga grupet kriminale, q\u00eb kan\u00eb fuqizuar bandat dhe jan\u00eb b\u00ebr\u00eb shkak p\u00ebr p\u00ebrplasje t\u00eb dhunshme deri edhe vrasje.<\/p>\n<p>Por sipas projektligjit, kultivimi i kanabisit p\u00ebr q\u00ebllime mjek\u00ebsore do t\u00eb kryhet n\u00ebn kontrollin e rrept\u00eb t\u00eb qeveris\u00eb.<\/p>\n<p>Si fillim, nj\u00eb kompani duhet t\u00eb ket\u00eb eksperienc\u00eb n\u00eb k\u00ebt\u00eb fush\u00eb, t\u00eb jet\u00eb e licensuar nga Bashkimi Europian dhe duhet t\u00eb paguaj\u00eb nj\u00eb tarif\u00eb prej 100 milion lek\u00ebsh.<\/p>\n<p>Puna do t\u00eb monitorohet nga disa ministri, si ajo e Bujq\u00ebsis\u00eb, e Sh\u00ebndet\u00ebsis\u00eb dhe Policia e Shtetit.<\/p>\n<p>Projektligji q\u00eb mund t\u00eb gjendet i plot\u00eb KETU parashikon krijimin e nj\u00eb agjensie q\u00eb mbikqyr kompanit\u00eb q\u00eb do t\u00eb kultivojn\u00eb bim\u00ebn narkotike.<\/p>\n<p>Bari i mbjell\u00eb n\u00eb sera do t\u00eb jet\u00eb vazhdimisht i gjurmuesh\u00ebm p\u00ebrmes nj\u00eb regjistri elektronik dhe po ashtu i gjith\u00eb procesi i kultivimit, korrjes deri edhe paketimit dhe eksportimit.<\/p>\n<p>P\u00ebrcaktohet se nj\u00eb parcel\u00eb do t\u00eb jet\u00eb mes 5 dhe 10 hektar\u00eb. Nj\u00eb kompani q\u00eb kultivon kanabis mund t\u00eb ket\u00eb deri n\u00eb 4 parcela pran\u00eb nj\u00ebra tjetr\u00ebs, pra nuk mund t\u00eb ket\u00eb m\u00eb shum\u00eb se 40 hektar\u00eb gjithsej.<\/p>\n<p>\u201cSip\u00ebrfaqja totale e lejuar p\u00ebr kultivimin e bim\u00ebs s\u00eb kanabisit p\u00ebr q\u00ebllime mjek\u00ebsore nuk mund t\u00eb jet\u00eb m\u00eb e madhe se 150 hektar\u00eb n\u00eb rang komb\u00ebtar\u201d thuhet n\u00eb nenin 12 t\u00eb projektligjit.<\/p>\n<p>Monitorimi do t\u00eb jet\u00eb i rrept\u00eb, me nj\u00eb mori licensash dhe me detyrimin p\u00ebr t\u00eb gjurmuar elektronikisht bim\u00ebt e kanabisit.<\/p>\n<p>\u201cGjat\u00eb faz\u00ebs s\u00eb verifikimit ministri mund t\u00eb vendos\u00eb pezullimin e lejes s\u00eb kultivimit\u201d thuhet n\u00eb nenin 20 t\u00eb projektligjit.<\/p>\n<p>Por historia e kontrollit t\u00eb k\u00ebtij biznesi nga grupet kriminale shton rrezikun e devijimit t\u00eb barit narkotik pasi \u00ebsht\u00eb prodhuar. Po sikur nj\u00eb kompani e licensuar t\u00eb vendos\u00eb ta trafikoj\u00eb, n\u00eb vend se ta d\u00ebrgoj\u00eb drejt laborator\u00ebve mjek\u00ebsor\u00eb?<\/p>\n<p>Penalitetet parashikohen n\u00eb \u201cNenin 40\u201d dhe ndryshe nga \u00e7far\u00eb ndodh deri tani, kur trafikant\u00ebt e kanabisit d\u00ebnohen me burg, p\u00ebr t\u00eb licensuarit e prodhimit t\u00eb kanabisit mjek\u00ebsor do t\u00eb ket\u00eb vet\u00ebm gjoba.<\/p>\n<p>Nd\u00ebshkimi do t\u00eb jet\u00eb 5 milion lek\u00eb, n\u00ebse ka shkelje t\u00eb tilla si reklamimi i barit, apo mosdeklarimi i sip\u00ebrfaqeve t\u00eb mbjella, apo refuzimi p\u00ebr t\u00eb deklaruar parcelat, apo kur tejkalohet masa e parcelave t\u00eb licensuara p\u00ebr kultivim t\u00eb kanabisit.<\/p>\n<p>Sipas nenit 40 n\u00eb projekt-ligj, n\u00ebse nj\u00eb kultivues i kanabisit ka mbjell\u00eb m\u00eb shum\u00eb parcela se \u00e7\u2019ka deklaruar dhe konstatohet se \u201cnuk merr masa p\u00ebr keqp\u00ebrdorim t\u00eb kanabisit\u201d, ai nuk d\u00ebnohet me burg, si\u00e7 ka ndodhur deri tani, por vet\u00ebm me gjob\u00eb.<\/p>\n<p>Neni ku p\u00ebrcaktohen penalitetet p\u00ebr abuzimet me kultivimin e kanabisit duket krejt\u00ebsisht i paqart\u00eb, por n\u00eb thelb l\u00eb nj\u00eb hap\u00ebsir\u00eb t\u00eb konsiderueshme kultivuesve, n\u00ebse k\u00ebta tentojn\u00eb ta trafikojn\u00eb l\u00ebnd\u00ebn ndarkotike. I plot\u00eb m\u00eb posht\u00eb:<\/p>\n<p><strong>Neni 40<\/strong><\/p>\n<p>Kund\u00ebrvajtjet<\/p>\n<p>1. Kur nuk p\u00ebrb\u00ebjn\u00eb vep\u00ebr penale, shkeljet e dispozitave t\u00eb k\u00ebtij ligji p\u00ebrb\u00ebjne kund\u00ebrvajtje administrative dhe do t\u00eb d\u00ebnohen me nj\u00eb gjob\u00eb deri n\u00eb mas\u00ebn 5.000.000 (pes\u00eb milion\u00eb) Lek\u00eb, n\u00ebse:<br \/>\na. B\u00ebn reklam\u00eb p\u00ebr prodhimin, n\u00eb m\u00ebnyr\u00eb direkte ose indirekte, ose b\u00ebn shitje direkte; me pakic\u00eb;<br \/>\nb. Nuk zbaton masat e shprehura me vendim nga inspektori mbik\u00ebqyr\u00ebs;<br \/>\n\u00e7. Pengon procesin e marrjes s\u00eb mostrave;<br \/>\nc. Kultivon kanabis p\u00ebr q\u00ebllime industriale, pa kontrat\u00eb paraprake dhe n\u00eb kushte t\u00eb shkeljes s\u00eb ligjit;<br \/>\nd. Kur ka mbjell\u00eb dhe administruar sip\u00ebrfaqe m\u00eb t\u00eb m\u00ebdha me kanabis industrial, ose kur regjistrimin e sip\u00ebrfaqeve nuk e ka kryer brenda afatit t\u00eb parashikuar;<br \/>\ngj. Nuk deklaron sip\u00ebrfaqet n\u00eb t\u00eb cilat kultivon kanabis p\u00ebr q\u00ebllime mjek\u00ebsore dhe\/ose kanabis p\u00ebr q\u00ebllime industriale;<br \/>\ne. Kryen pro\u00e7ese p\u00ebr t\u00eb cilat nuk \u00ebsht\u00eb i autorizuar ose nuk dor\u00ebzon brenda afatit t\u00eb parashikuar n\u00eb ligj raportet e nevojshme p\u00ebr institucionet mbik\u00ebqyr\u00ebse dhe kontrolluese;<br \/>\nf. Tejkalon afatin e caktuar p\u00ebr grumbullimin e sasive t\u00eb prodhuara t\u00eb kasht\u00ebs s\u00eb kanabis p\u00ebr q\u00ebllime mjek\u00ebsore dhe\/ose kanabis p\u00ebr q\u00ebllime industriale;<br \/>\ng. Nuk e njofton ministrin\u00eb p\u00ebrgjegj\u00ebse p\u00ebr rendin dhe sigurin\u00eb publike, ministrin\u00eb p\u00ebrgjegj\u00ebse p\u00ebr bujq\u00ebsin\u00eb dhe ministrin\u00eb p\u00ebrgjegj\u00ebs\u00eb p\u00ebr sh\u00ebndet\u00ebsin\u00eb p\u00ebr \u00e7do gjendje q\u00eb tregon dyshim se kanabisi ose pjes\u00eb t\u00eb bim\u00ebve jan\u00eb p\u00ebrdorur ose do t\u00eb mund t\u00eb p\u00ebrdoren p\u00ebr prodhimin e l\u00ebnd\u00ebve psikoaktive;<br \/>\nh. Kultivon kanabis p\u00ebr q\u00ebllime industriale pa autorizimin p\u00ebrkat\u00ebs;<br \/>\ni. Nuk mban Regjist\u00ebr p\u00ebr sasin\u00eb e prodhuar dhe at\u00eb t\u00eb bler\u00eb t\u00eb kanabisit p\u00ebr q\u00ebllime mjek\u00ebsore dhe\/ose industriale nuk dor\u00ebzon raportin brenda afateve ligjore tek autoritetet mbik\u00ebqyr\u00ebse;<br \/>\nj. Punon n\u00eb kushte q\u00eb jan\u00eb n\u00eb kund\u00ebrshtim me autorizimin e dh\u00ebn\u00eb;<br \/>\nk. Nuk p\u00ebrs\u00ebrit k\u00ebrkes\u00ebn p\u00ebr rip\u00ebrt\u00ebritjen e lejeve;<br \/>\nth. Reklamon produktet me baz\u00eb kanabis n\u00eb m\u00ebnyr\u00eb t\u00eb drejtp\u00ebrdrejt\u00eb ose t\u00eb fsheht\u00eb;<br \/>\nx. Nuk tregon kujdes p\u00ebr ruajtjen e bim\u00ebve n\u00eb mjedise t\u00eb ve\u00e7anta p\u00ebr magazinim, tharjen etj, duke lejuar hyrjen e personave t\u00eb paautorizuar;<br \/>\nxh. Nuk korrespondojn\u00eb t\u00eb dh\u00ebnat e regjistrave t\u00eb tij me regjistrat e institucioneve pas verifikimit nga Agjencia Komb\u00ebtare e Barnave dhe Pajisjeve Mjek\u00ebsore dhe Ministria p\u00ebrgjegj\u00ebse p\u00ebr sh\u00ebndet\u00ebsin\u00eb;<br \/>\ny. Nuk b\u00ebhet administrim rigoroz i qarkullimit t\u00eb personave t\u00eb paautorizuar n\u00eb mjediset e brendshme dhe \u00e7el\u00ebsat e mjediseve ose kasafortat ku ruhen far\u00ebrat, regjistrat etj., p\u00ebrdoren pa mbik\u00ebqyrje dhe protokoll;<br \/>\nz. Nuk regjistron n\u00eb koh\u00eb reale kur b\u00ebhet secili import, eksport, transport, blerje, shitje ose nuk ruan dokumentacionin p\u00ebr nj\u00eb periudh\u00eb minimale prej pes\u00eb vjet;<br \/>\nzh. Nuk dor\u00ebzon raporte analize dhe nj\u00eb vler\u00ebsim p\u00ebr nevojat p\u00ebr vitin e ardhsh\u00ebm;<br \/>\naa. Nuk dor\u00ebzon raporte vjetore p\u00ebr sasit\u00eb e konfiskuara ose t\u00eb shkat\u00ebrruara t\u00eb bim\u00ebve dhe preparateve;<br \/>\nbb. Heq, prish, manipulon pajisjet, shenja, etiketat apo pullat e parashikuara n\u00eb nenin 34 t\u00eb k\u00ebtij ligji.<br \/>\ncc. Pengon, shmang inspektimin apo verifikimin mbi gjurmueshm\u00ebrin\u00eb ose shmang sistemin e sh\u00ebnjimit dhe gjurmimit;<br \/>\ndd. Kultivon, prodhon, p\u00ebrpunon, furnizon,tregton, mban, transporton, bim\u00eb,fara, produkt me l\u00ebnd\u00eb psikoaktive dhe substanca psikotrope t\u00eb pa shenjuar sipas p\u00ebrcaktimeve n\u00eb 34 p\u00ebr Shenjimin dhe Gjurmimin.<br \/>\n2. Krahas gjob\u00ebs s\u00eb parashikuar nga paragrafi 1 i k\u00ebtij neni, personit juridik mund t\u2019i caktohet edhe sanksion p\u00ebr kund\u00ebrvajtje ndalim i p\u00ebrkohsh\u00ebm i kryerjes s\u00eb veprimtaris\u00eb. Koh\u00ebzgjatja e ndalimit t\u00eb veprimtaris\u00eb caktohet nga gjasht\u00eb muaj deri n\u00eb tre vjet.<br \/>\n3. Krahas gjob\u00ebs, p\u00ebr veprimtarit\u00eb q\u00eb ushtrohen n\u00eb shkelje apo tejkalim t\u00eb ligjit, personit p\u00ebrgjegj\u00ebs n\u00eb personin juridik i caktohet edhe masa ndalim i kryerjes s\u00eb veprimtaris\u00eb. Koh\u00ebzgjatja e ndales\u00ebs nuk mund t\u00eb jet\u00eb m\u00eb e gjat\u00eb se nj\u00eb vit.<br \/>\n4. Personi p\u00ebrgjegj\u00ebs n\u00eb personin juridik i caktohet gjob\u00eb n\u00eb shum\u00ebn prej 300 000 (treqindmij\u00eb) lek\u00eb deri n\u00eb 700 000 (shtat\u00ebqindmij\u00eb) p\u00ebr kund\u00ebrvajtje n\u00ebse:<br \/>\na. rezulton se p\u00ebrtej afatit prej kat\u00ebr muajsh pas p\u00ebrfundimit t\u00eb korrjes nuk e ka dor\u00ebzuar ende prodhimin e plot\u00eb, p\u00ebrkat\u00ebsisht t\u00eb gjitha sasit\u00eb e pjes\u00ebve t\u00eb kanabisit p\u00ebr q\u00ebllim, t\u00eb cilat mund t\u00eb sh\u00ebrbejn\u00eb p\u00ebr prodhimin e l\u00ebnd\u00ebve psikoaktive;<br \/>\nb. nuk b\u00ebn deklarim t\u00eb sakt\u00eb p\u00ebr sip\u00ebrfaqet p\u00ebr prodhimin e bim\u00ebve, ose i deklaron p\u00ebrtej afatit prej 15 dit\u00ebsh pas mbjelljes;<br \/>\nc. kultivon kanabis industrial pa miratim dhe me kushte n\u00eb kund\u00ebrshtim me dispozitat e k\u00ebtij ligji;<br \/>\n\u00e7. nuk i paraqet sip\u00ebrfaqet p\u00ebr prodhim t\u00eb kanabisit p\u00ebr q\u00ebllim n\u00eb afat m\u00eb von\u00eb se 15 dit\u00eb pas mbjelljes;<br \/>\nd. e dor\u00ebzon prodhimin e plot\u00eb p\u00ebrtej afatit prej kat\u00ebr muaj pas mbarimit t\u00eb korrjes, p\u00ebrkat\u00ebsisht t\u00eb gjitha sasit\u00eb e pjes\u00ebve t\u00eb, q\u00eb sh\u00ebrbejn\u00eb p\u00ebr prodhimin e l\u00ebnd\u00ebve psikoaktive;<br \/>\ndh.nuk p\u00ebrdit\u00ebson regjistrat me t\u00eb dh\u00ebnat q\u00eb parashikon ligji brenda afatit dhe n\u00eb koh\u00eb reale, si dhe kur nuk dor\u00ebzon raportin brenda afateve t\u00eb parashikuara;<br \/>\ne. nuk p\u00ebrgatit njoftimin e menj\u00ebhersh\u00ebm p\u00ebr Ministrit\u00eb dhe autoritetet p\u00ebrgjegj\u00ebse p\u00ebr mbik\u00ebqyrjen p\u00ebr \u00e7do gjendje q\u00eb tregon dyshim se k\u00ebrpi ose pjes\u00ebt e kanabisit p\u00ebr q\u00ebllim jan\u00eb p\u00ebrdorur ose do t\u00eb mund t\u00eb p\u00ebrdoren p\u00ebr prodhimin e l\u00ebnd\u00ebve psikoaktive;<br \/>\n\u00eb. nuk i merr t\u00eb gjitha masat q\u00eb t\u00eb ndaloj\u00eb keqp\u00ebrdorimin e bim\u00ebve dhe\/ose d\u00ebmtimin e tyre;<br \/>\nf. heq, d\u00ebmton, manipulon, pajisjet, shenjat, etiketat apo pullat si dhe pengon, shmang inspektimin apo verifikimin mbi gjurmueshm\u00ebrin\u00eb sipas p\u00ebrcaktimeve t\u00eb k\u00ebtij ligji.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Pak dit\u00eb pasi Shqip\u00ebria u rendit e shtata n\u00eb bot\u00eb p\u00ebr vendet e p\u00ebrmendura n\u00eb trafikun e kanabisit, qeveria Rama hodhi p\u00ebr konsultim projekt-ligjin q\u00eb i hap rrug\u00eb kultivimit t\u00eb kanabisit mjek\u00ebsor.
